Pindle - Terms and Conditions  Purpose
The following terms and conditions are intended to define the basic stipulations regarding the rights and obligations of the services (“hereinafter referred to as “services”) provided by the Pindle (hereinafter referred to as “the company”) application and its users.  Definitions The definition of the terms used in the Terms and Conditions are as follows:"Pindle" means "location-based, photo sharing service" provided by the "Company"on a user screen (e.g. mobile device)."Affiliate" means the person or organization that provides the "content" of the "affiliate".“Content” means but not limited to information, images, written content, files, design, layout data, software programs and code of the services provided by the Company.  "User"means the people who use the services.

Effects of The Terms
You must first agree to these terms and conditions in order to use the services.  If you do not agree to the terms and conditions, you will not be able to use the services.  The terms and conditions will be in effect as long as an user uses the services. The Company may change these terms and conditions in accordance with applicable laws and regulations.  If the Company changes the terms and conditions, users shall be informed 10 days prior to the effective date (30 days prior to the change in case of significant / community wide modifications).  The Company shall not separately notify you if the user does not express its intention to refuse the changes to the terms and conditions, and if the user does not express his or her intention to decline within this period, it may be deemed to have agreed to the terms. If the user does not agree to the terms and conditions of the change, the Company may terminate the contract with the user or restrict the user's use of the services.  Personal Information The Company may collect minimum amounts of personal information necessary for the use of the service. The laws and regulations regarding the protection of personal information apply to such personal information collected. The Company will do its best to protect the personal information of its users.  Please refer to the privacy policy in the Service Settings menu to determine how the Company protects and handles your personal information. You agree to the collection and use of personal information in accordance with the Company's Privacy Policies.  


Notice to Users
The Company may use an email address, telephone number or other alternative methods provided to the Company by the user for notification.  If the user 1) does not provide contact information, 2) does not notify the Company when the user’s contact information has changed, 3) notification is required for all users and/or individual notification is difficult, the Company may replace the individual notice stipulated in the preceding paragraph by posting the notice in the Pindle application and website for at least one week.  Regarding urgent and critical notifications (e.g. termination of the user) the posting period shall be 30 days.   Services This service displays and shares the user’s content on the service map based on GPS data. The content and scope of the service may be changed according to operational and technical needs such as the country, the type of terminal and OS used, SIM card, and internal policies of the company and affiliates. In order to use the service, a wired or wireless network connection is required and network charges may occur due to the use of data. You are solely responsible for any costs that may arise in connection with this usage. This service is provided free of charge.  However, depending on future circumstances, the service may include service fees as we add additional services.  Limitations, Modifications, Suspensions and

Termination of Services

The company may temporarily suspend services if there is a significant reason for inspection, replacement, failure, communication loss, or operation of the facility. In the event of limiting, changing, suspending or terminating the service pursuant to paragraph 2, if this causes a significant effect on the user's rights and obligations, the Company shall notify or notify the user in advance of the appropriate method, such as the method set forth in Article 4.  However, this is not the case if the service is suspended, restricted, changed, or terminated due to uncontrollable reasons, or if notification to the user is not possible due to an emergency, etc.  When notification becomes possible, users will be notified immediately. The company will not compensate the user for any modification, change, suspension, or termination of any or all of the services unless there is a special provision in the relevant laws. Affiliate service suspension, change, restriction, termination, and related user compensation policies are conducted by affiliates in accordance with affiliate policies.  Related matters must be handled directly by affiliates and users in accordance with affiliate service terms and related laws. At any time, the company may provide or conduct service updates or upgrades (hereinafter referred to as "updates"), including bug fixes, service enhancements, new features, deletion of existing features, and service changes. Updates are governed by the Terms and Conditions unless otherwise provided. Security software, critical bug fixes or other important updates that need to be made in a timely manner can be automatically downloaded and installed. The company reserves the right to change, suspend, remove, restrict, or block access to the service or parts of the service according to changes in the service delivery environment, expiration of the license period, and technical operational needs.  Partnership and Affiliate Content Management
Affiliate and partnership content are provided directly by partners and affiliates to users, and the company only operates the system as a content providing medium and does not act on behalf of partners and/or affiliates, and all partners and/or affiliates are responsible for the contents provided by partners and affiliates.
All services provided by affiliates (e.g. partner terms of service, identity verification, etc.), all rights and responsibilities for service use and matters related to affiliate services such as compensation for damages are directly handled by affiliates and users.  The Company shall not intervene or be liable for any legal disputes related to this unless there is legal reason to do so.

Protection of Minors
If a minor uses the service, prior consent must be obtained from a legal representative, such as a parent. A minor's legal representative must supervise the minor's use of the service, assume all risks and responsibilities associated with the minor's use of the service, and ensure the accuracy and authenticity of any information submitted by the minor.

Use of Service
The user must comply with the following terms and conditions including all instructions provided by the company and / or affiliates to the user and any laws and regulations applicable to the user. In addition, the company is not responsible for legal actions by affiliates or related organizations for users caused by the violation of this clause, and the company may take necessary legal actions if it finds the above in violation.  Intellectual Property All legal rights such as intellectual property rights (including copyright, trademark rights, patent rights, utility model rights, design rights, database rights, and trade secrets), ownership, use, and profit rights for the service and all materials included therein are the rights of the company. Users acquire personal, non-exclusive and non-transferable limited service usage rights within the scope for using the service. Certain security measures may be set in the service. Users will not be permitted to disable or arbitrarily disable it. The user shall not use the service or any materials included therein by copying, transmitting, distributing, broadcasting, or through other methods or making it available to a third party unless a separate prior written consent is obtained from the company or a separate contract is signed with the company. It should not be used for commercial purposes or for others to use for commercial purposes. It also cannot be provided or transferred as a lease, rental, re-licensing, sale, transfer, or as collateral. Users cannot arbitrarily remove, obscure, or change the contents of the service and the notifications related to ownership, intellectual property rights, and other related rights. When using the service, the user may not produce or use the same or similar content, such as any name, trade name, trademark, etc. that indicates the product or service of another person, and content that indicates the business of another person. In the process of using the service, the information entered by the user or submitted to the company, and various information collected through other services (hereinafter referred to as “information”) are analyzed and utilized for purposes such as service improvement, new product development, service development and specialty can be. Disclaimer
The Company does not guarantee the following:That it may or may not be availability at all times or at a specific time, or that its content and use are safe and / or error free.That it meets the user's requirements or meets a certain level of performance or functionality.Safe from viruses, hacking, damage or other security intrusions. However, the company makes reasonable efforts based on current levels of technology to protect users from various security intrusions. Relationships - Between Users and Third Parties

These Terms and Conditions do not affect the legal relationship between the user and other third parties, and the user is solely responsible for the interaction with other users in the service. The Company does not guarantee the accuracy and legitimacy of information, data, and other data posted or exchanged by users in connection with the Service, and may be caused by defamation or other illegal acts arising in the course of using the service between users or between users and third parties. We do not intervene or take any responsibility for civil and criminal matters.  

Advertisement
Services may be supported by advertising revenue. The company may post advertisements or publicity-related information provided by the company or a third party to the service and provide it to users who have consented to receive it by means of e-mail or text message, push notification, etc. When a user uses information related to advertisements and promotions in the previous paragraph or communicates or deals with the advertiser, this is entirely a matter between the user and the advertiser. Therefore, the company assumes no responsibility or obligation.  

Others
If any provision of these Terms and Conditions becomes invalid, the remaining provisions of these Terms and Conditions will remain in effect. The User may not transfer, transfer, impose or otherwise process any rights or obligations of the User in accordance with this Agreement or this Agreement to a third party without the prior written consent of the Company. The laws of the Republic of Korea apply to this Agreement and between the User and the Company under this Agreement.  Dispute related to the service between the company and the user shall be handled in the court having jurisdiction over the procedure established by the relevant laws and regulations.

Terms and Conditions for Location-based Services

General Provisions

Purpose
These terms and conditions are used by the Company to provide customers (hereinafter referred to as the “Customers”) with various contracts using the location-based services (hereinafter referred to as the “Services”) by Pindle Corporation (hereinafter referred to as the “Company”). The Company collects, uses or provides personal location information, and provides personal information to the location-based service provider in accordance with the provisions of the Act on the Protection and Use of Location Information (hereinafter referred to as the “Location Information Act”) in the position of the location information provider. The purpose is to determine the rights and obligations between the company and its customers, the company and the location-based service provider, and other matters necessary for providing location information.

Conditions Other Than Agreement
For matters not specified in these terms and conditions, follow the relevant laws and regulations, such as the Location Information Act, the Telecommunications Business Act, the Act on Promotion of Information and Communication Network Utilization and Information Protection, the terms of use of each service, and the guidelines set by the company.

Use of Service
Service Type and Usage FeesThe company directly collects location information or provides location information from location information providers to provide services.The contents and service charges provided by the company are in accordance with Types of Location-Based Services and Charges.

How to Collect Personal Location Information
The company collects location information according to the method specified in Location Information Collection Method.If the method of collecting personal location information specified in Paragraph 1 changes, the company will place notification through Internet channels or notify the customer. However, if there is a reason beyond the control of the company and prior notice is not possible, the notice will be given afterwards.

Service
The customer can use the service by agreeing to the terms and conditions set by the company and accepting them.The company may not approve the application for use by customers falling under any of the following items.

1. In case of false application, such as not using real name or using another person's name
2. In the case of missing or incorrect customer registration
3. When applying for the purpose of hindering or hindering public order or morals
4. If the application requirements set by other companies are not satisfied

Customers may be limited to service usage depending on their qualifications, and customer qualifications and service usage may change depending on the changes (name changes, terminations, etc.) of the service of the subscribed mobile communication service company.

Termination of Service
Customers who wish to terminate the service can apply for service termination through the procedure (notified through the wired/wireless internet website, etc.) determined by the company.


Level of Service
In principle, use of the service is 24 hours a day, 7 days a week. However, the service may be suspended for business or technical reasons, and the service may be suspended for a period determined by the company for operational purposes. In this case, the company will notify you in advance or in the future.Location information may cause or be in error due to the development of related technologies and improvements.

Restriction and Suspension of Service
The company may limit or suspend the use of the customer's service or terminate use without prior notice if the customer falls under any of the following items:
1. In the case of using the personal information of another person to register and/or use the service illegally
2. If you interfere with the use of other people's services
3. If you use the service to act against the law, public order, morals, etc.
4. When the customer intentionally or unduly interferes with the operation of the service

Change and Suspension of Service
The company may limit, change or suspend all or part of the service in any of the following cases:
1. Inevitable due to construction such as repair of service equipment
2. If there is a problem with the normal use of the service due to power outages, failure of all facilities, or runaway of usageIf the service cannot be maintained due to various circumstances of the company, such as termination of a contract with a service partner, or a legal obstacle, etc.
3. When the mobile communication service company to which the customer has subscribed has stopped the service.
4. If there is any force majeure reason such as natural disaster or national emergencyIn the event of a service restriction under paragraph 1, the company will notify via the Internet or notify the customer. However, in the event that prior notification is not possible due to limitations of the service and due to reasons beyond the company's control, such as disk failure without cause of the company's fault, or system failure, a notice will be given thereafter.

Protection of Personal Location Information

Protection of Customer Location Information
The company strives to protect the customer's personal location information in accordance with laws and regulations.

Collection, Use or Provision of Personal Location Information
The company may collect and use the customer's personal location information to provide the service, and the customer is deemed to have agreed by agreeing to these terms and conditions.The company does not provide personal location information provided by the customer to a third party without the customer's consent.The company does not use the personal location information provided by the customer for purposes other than providing services without the customer's consent.

Notification of Provision of Personal Location Information
When the company provides the customer's personal location information to a third party designated by the customer, the company immediately notifies the recipient, the date and time of delivery, and the purpose of providing the personal location information through the target terminal collecting personal location information.

However, in any of the following cases, the customer may be notified to the channel/terminal designated by the customer or by other objectively appropriate means such as e-mail:

1. When the target channel/terminal that collects personal location information does not have the function of receiving text, voice, or video
2. If requested in advance by the customer

The Company may collect and notify information provided to third parties for a certain number of times or periods within a range of up to 30 days with the consent of the customer, despite the provisions of paragraph 1.


Retention of Data to Collect, Use, and Provide Location Information
The company automatically records the location information collection, use, and provision fact confirmation data for customers in accordance with the Location Information Act, and preserves it for 12 months from the time of recording.

In the event that the customer withdraws all or part of the consent pursuant to the Location Information Act, the company shall collect personal location information and information confirming the collection, use and provision of location information without delay (part of the consent. In the case of withdrawal, the personal location information and location information collection, use and provision of the withdrawal information are limited). However, if there is a need to preserve it according to the provisions of other laws and regulations, it will be preserved according to the relevant laws and regulations.

Retention and Use Period of Personal Location Information
When the company achieves the purpose of collecting, using, or providing the personal location information of the customer, the customer's personal location other than the confirmation of the fact that the location information is used and provided in accordance with the Location Information Act. Rights of Legal Representatives
When a company intends to collect, use, or provide personal location information from children under 14 years of age in accordance with the provisions of the Location Information Act, it must obtain the consent of the user and their legal representative.The provisions of Customer's Rights of this Agreement shall apply mutatis mutandis when the legal representative agrees in accordance with of the Location Information Act. In this case, “customer” is considered as “legal representative”.

Use of location information to protect children under 8
The person who falls under any of the following subparagraphs (hereinafter referred to as “children under the age of 8”, etc.): The personal location of children under the age of 8 to protect the life or body of children under the age of 8 If you agree to the collection, use or provision of information, you will be deemed to have your own consent.

1. Children under 8 years old

3. The provisions of Customer's Rights of this Agreement shall apply mutatis mutandis when the legal representative agrees in accordance with the Location Information Act. In this case, the “customer” is regarded as the “protection officer”.

Rights and Obligations of the Company and Customers

You can utilize. However, in case of using or exceeding the scope of the customer's consent, the customer must obtain the consent in advance. In this case, the customer can refuse the company's request for consent.

When requesting a customer to register as a bad credit, such as a credit information concentrating institution of the Act on the Use and Protection of Credit Information in connection with the delinquency of charges, the company must go through the necessary verification procedures such as the identity of the person requesting the registration. .

You must comply with the notices of the company and the company, and do not engage in any acts that interfere with the company's business.

TransferCustomers, companies and location-based service providers cannot transfer, delegate, or provide collateral/power of attorney for all or part of the rights and obligations of this Agreement to a third party.Compensation for DamagesIf a customer or location-based service provider incurs damages to the company due to violation of the provisions of this agreement, the party who violates this agreement must compensate for all damages to the company.In the event that the company receives various objections including claims for damages or lawsuits from third parties due to illegal activities of customers or location-based service providers or violations of these terms and conditions, the party who has committed the illegal activities or violations of the terms and conditions shall be responsible. The company must indemnify the company for excessive expenses, and if the company fails to indemnify, the customer must compensate for the damage caused to the company.

In the event of damage to the customer due to an act that violates the provisions of the Company's Location Information Act or services provided by the company, the company is liable for the customer's damages if it does not prove that there is no intention or negligence The scope of liability is limited to ordinary damages.

Disclaimer
The company shall not be liable for damages caused by any of the following cases.In the event of a natural disaster or a force majeure equivalentCustomer, location-based service provider, or other third partyIn case of other company's intention or negligenceThe company is not responsible for the loss of profits expected by customers using the service, and is not responsible for any damages caused by data obtained through the service.The company does not guarantee the reliability, accuracy, etc. of information, data, and facts posted on the service, and the final judgment on the information obtained by using the service and service provided by the company must be made by the customer. Is entirely on the customer himself, and the company is not responsible for any damages arising from it.
If the service cannot be provided normally due to a business or technical obstacle of the company, the company will notify the customer on the Internet website, etc., or by e-mail or SMS. However, if it is impossible to notify in advance due to reasons beyond the control of the company, it will be notified in the future.

Dispute Resolution
When a dispute arises between the company and a customer or a location-based service provider regarding the collection of personal location information or the provision of a service, the company and the customer or the location-based service provider will faithfully consult to resolve the dispute.If the dispute between the company and the customer is not resolved despite the consultation in paragraph 1, both parties may apply for mediation to the Personal Information Dispute Mediation Committee pursuant to the Personal Information Protection Act.In spite of the consultations in paragraph 1, if the dispute between the company and the location-based service provider is not resolved, both parties can apply for finances to the Korea Communications Commission.
How to Collect Location InformationThe company collects and provides location information as follows.The service is made by the contract between the company and the customer, and the location information collected from the customer is used only for the purpose of using the company as a location information provider and a location-based service provider. It cannot be used by a third party unless otherwise agreed between the customer and the customer.

When the company collects the customer's location information, it collects only the customer's target terminal number and location coordinates necessary to provide the service, and is safely managed by access control technology.

The company collects location information in the following three ways.

1. A method of receiving location information measured through a GPS receiving module in a terminal and obtaining location information

2. A method of calculating location information in a terminal or server in connection with information of a preconfigured server DB (network-based location information providing server DB) using the Wi-Fi AP Mac Address value around the terminal or surrounding Cell ID information and electric field strength
